Authority & Governance

Authority has a source, a scope, and a history.

Pactum Governance preserves the basis upon which representative authority is recognized: who may act, for which institution, within what scope and conditions, during what period, and through what chain of authority.

Representative authority is not inferred from identity, association, participation, or technical access.

01 · Definition

Representative authority is a bounded institutional fact.

Representative authority concerns an individual's capacity to act for an institution in a manner upon which Moravax may rely. It must remain attributable to an identifiable basis rather than being inferred from technical or organizational proximity.

Pactum preserves the represented institution, the source of authority, the actions permitted, applicable conditions, effective period, and the later events that change its current state.

Authority is recognized within a defined institutional context and remains bounded by the source, scope, conditions, and time that give it meaning.

02 · Sources

Authority may enter Pactum through different institutional paths.

Pactum preserves where authority came from and distinguishes authority that existed before a Pactum act from authority created through a later governed delegation or other valid institutional act.

Originating / External

Authority exists before the Pactum act.

An institution, governing instrument, appointment, office, decision, or another appropriate source may establish authority independently of Pactum. Moravax records the basis upon which that authority is recognized for the relevant institutional purpose.

Recording the authority does not mean Moravax created the external institutional source from which it derives.

Derived / Delegated

Authority may be created through a valid authority-bearing act.

A representative who already possesses suitable authority may, where delegation is permitted, create a narrower authority for another representative. Pactum preserves the act through which that derived authority comes into institutional effect.

Derived authority cannot legitimately exceed the authority and delegating power from which it originates.

Moravax-Originated

Moravax may create authority within its own institutional competence.

Moravax may establish permissions, participation states, or other authority that belongs to Moravax to confer. Those states remain distinct from representative authority that only another institution can establish for itself.

A Moravax technical permission does not make an individual a representative of an external institution.

03 · Recognition

Recognition is bounded to the institutional purpose for which authority matters.

Moravax may need to determine whether there is sufficient institutional basis to rely upon a person's claimed authority in a defined context. That recognition concerns the authority relevant to the particular institutional relationship or governed act.

Evidence may establish specific facts about identity, appointment, execution, scope, or current status. Pactum preserves those facts and their provenance without treating one evidentiary source as a substitute for the authority relationship as a whole.

Pactum preserves the basis upon which Moravax recognizes representative authority for a defined institutional purpose.

04 · Dimensions

Authority must remain intelligible beyond the name of the representative.

A durable authority record requires more than a statement that one person is authorized. Its institutional meaning depends upon dimensions that may change independently over time.

The institution or authorized actor whose decision or status gives rise to the authority.

The actions, matters, resources, or institutional effects within which the authority may be exercised.

Prerequisites, restrictions, approval dependencies, or other conditions that constrain legitimate exercise.

Effective period
When authority begins, when it may be exercised, and when suspension, revocation, expiration, or supersession changes current state.

Derivation
Where applicable, the prior authority from which a delegated or otherwise derived authority descends.

Evidence and history
The provenance needed to substantiate the authority and reconstruct how its institutional meaning changed over time.
05 · Derivation

Delegated authority remains connected to the authority from which it derives.

When a representative creates authority for another person, Pactum preserves the chain rather than treating the resulting authority as an unexplained standalone permission.

Technical ability to create or modify an authority record does not itself establish the institutional authority required to do so.

06 · Distinctions

Authority remains distinct from the facts and mechanisms around it.

Several facts may be relevant to a governed act without becoming substitutes for representative authority.

Authentication is not authority. Proving control of an account or session does not establish representative power.
Association is not authority. Affiliation with an institution does not by itself establish authority to bind or materially alter its position.
Participation is not authority. A person may legitimately participate in an institutional relationship without possessing representative authority over consequential acts.
Technical permission is not authority. A technical capability may enable an operation only after its institutional basis is established.
07 · Authority over time

Current authority may change without erasing historical authority.

A later revocation or expiration changes what may be done now. It does not make a valid earlier authority or a valid earlier exercise disappear from institutional history.

01 Recognized A sufficient institutional basis exists for Moravax to rely upon the authority within a defined purpose.
02 Exercisable Scope, conditions, time, and relevant predicates permit current exercise.
03 Changed Scope, conditions, representation, or derivation may be amended, narrowed, suspended, or superseded.
04 Revoked or expired Current exercise ceases according to the governing event or effective period.
05 Historically retained Prior validity, exercise, and later change remain reconstructable rather than being overwritten by current state.

Authority must remain understandable both as a current institutional condition and as a historical fact whose meaning may differ across time.
